California Wage Garnishment Forms

WG-035 Confidential Statement of Judgment Debtor’s Social Security Number

The WG-035 form is a confidential document used in California wage garnishment cases to report the judgment debtor’s Social Security number. This form is required so the court and enforcing agencies can properly identify the correct individual. Because it contains sensitive information, it is kept separate from the public court file and must be handled carefully to avoid delays or compliance issues.

WG-001 Application for Earnings Withholding Order

The WG-001 form is used to request an earnings withholding order, which starts the wage garnishment process. This application is submitted to the court after a judgment has been entered. Once approved, it allows wages to be legally withheld from the debtor’s paycheck. Completing this form correctly is an important step in enforcing a court judgment.

WG-005 Employer’s Return

The WG-005 form is completed by the employer after they receive an earnings withholding order. It tells the court whether the debtor is employed, when they are paid, and whether the employer will comply with the garnishment. This form helps confirm employment details and ensures the garnishment process moves forward properly.

WG-003 Employee Instructions

The WG-003 form provides instructions to the employee whose wages are being garnished. It explains their rights, exemptions, and options, including how to claim a financial hardship if applicable. This form ensures the employee understands the garnishment and what steps they may take in response.

Writ of Execution (EJ-130)

The EJ-130 Writ of Execution authorizes the sheriff or levying officer to enforce a court judgment. In wage garnishment cases, this writ is often required before an earnings withholding order can be issued. It gives legal authority to carry out collection actions approved by the court.

WG-002 Earnings Withholding Order

The WG-002 form is the actual earnings withholding order sent to the employer. It instructs the employer to withhold a portion of the employee’s wages and send the funds according to the court order. This form is a key document in the wage garnishment process and must be served properly to be enforceable.
